Expungements



Everyone deserves a second chance.


  That's the theory behind the statutes that allow you to treat an arrest or conviction as though it NEVER EXISTED. That means if an employer or a landlord asks if you've been arrested or convicted, you can answer "No" and tell them the truth.

General criteria for expungements.


  • A conviction must be either (1) a class C felony, (2) certain B felony marijuana crimes, or (3) most any class of misdemeanor or violation.
  • No criminal convictions on your record for 10 years prior to expungement.
  • No new criminal charges.
  • Finished the sentence ordered by the court.


  • Waiting periods

  • 3 years have past since date of conviction or
  • 1 year for an arrest that did not result in a conviction.
  • No waiting period to expunge an arrest that was dismissed, acquitted, or that resulted in a not guilty verdict.

What's not expugnable?


  
  • Sex crimes, child abuse, traffic crimes, and traffic violations
  • Class B felonies (except certain marijuana crimes)
  • Class A felonies.
  •   We prepare and file all the necessary paperwork to expunge a conviction or arrest. We even help to arrange your fingerprinting and obtaining a copy of your criminal record from the police. Then we file all the necessary motions, orders, and affidavits with the Court and the District Attorney's office. If the DA objects, we argue the expungement in court. The process typically takes about three months, but can be longer or shorter depending on the DA's or the Court's caseload. After expungement, you'll start out fresh, with a clean slate, as though nothing happened.
