Expungements



Everyone deserves a second chance.


  That's the theory behind the statutes that allow you to treat an arrest or conviction as though it NEVER EXISTED. That means if an employer or a landlord asks if you've been arrested or convicted, you can answer "No" and tell them the truth.

General criteria for expungements.


  • A conviction must be either (1) a class C felony, (2) certain B felonies or (3) most any class of misdemeanor or violation.

What's not expungeable?


  
  • Sex crimes, child abuse, traffic crimes, traffic violations and most DUIIs
  • Certain Class B felonies
  • Certain Class A felonies
  •   I prepare and file all the necessary paperwork to expunge a conviction or arrest. I even help to arrange your fingerprinting and obtaining a copy of your criminal record from the police. Then I file all the necessary motions, orders, and affidavits with the Court and the District Attorney's office. If the DA objects, I argue the expungement in court. The process typically takes about three months, but can be longer or shorter depending on the DA's or the Court's caseload. After expungement, you'll start out fresh, with a clean slate.
